These Terms & Conditions (the “Terms”) constitute a legally binding agreement between you (the “user”, “customer”, “you”, or “your”) and Of Sheen Fine Jewelry (referred to as “Of Sheen”, “we”, “us”, or “our”), the owner and operator of the official Of Sheen website and all related sales channels.

By accessing our website, creating an account, placing an order, or using any of our services, you acknowledge that you have read, understood, and unconditionally agree to be bound by these Terms, as well as our Shipping & Delivery Policy, Returns & Refunds Policy, Privacy Policy, and all other supplementary policies posted on our website. If you do not agree with any part of these Terms, you must not access our website or place an order with us.


1. Definitions

For the purposes of these Terms, the following terms have the meanings set out below:

  • Business Days: Monday to Friday, excluding statutory public holidays.
  • Custom Products: Any jewelry item customized, engraved, resized, personalized, or made-to-order to your specific specifications.
  • Customs Fees: All import duties, value-added tax (VAT), consumption tax, customs clearance fees, brokerage charges, administrative levies, and any other fees imposed by the customs authority or government body of your destination country/region.
  • Delivery Date: The date on which the carrier confirms successful delivery and signature of your order at the shipping address you provided.
  • Pre-Order Items: Products available for advance purchase before their official in-stock release date, with a specified estimated shipping timeline.
  • Return Authorization (RA) Number: A unique, pre-approved identification number issued by our customer service team for eligible return requests.
  • Website: The official Of Sheen Fine Jewelry e-commerce website, including all subpages, content, and functionalities.

2. Acceptance of Terms & Modifications

2.1 These Terms apply to all visits to our website, account registrations, orders, purchases, and use of our services. Your continued use of our website and services constitutes ongoing acceptance of these Terms.
2.2 We reserve the right to update, amend, or modify these Terms at any time, at our sole discretion. Changes will be posted on this page with an updated effective date. It is your responsibility to review these Terms periodically. Your placement of an order after the updated effective date constitutes your acceptance of the revised Terms.
2.3 We reserve the right to suspend or terminate your access to our website and services at any time, without prior notice, for any violation of these Terms.


3. Eligibility & User Account Obligations

3.1 To place an order with us, you must be at least 18 years of age, or the age of majority in your jurisdiction, and have the legal capacity to enter into a binding contract. If you are under the age of majority, you must have the consent and supervision of a legal guardian to use our website and place an order.
3.2 You are responsible for providing accurate, complete, and up-to-date information when creating an account, placing an order, or communicating with us. We are not liable for failed delivery, order errors, or other losses resulting from incorrect or incomplete information you provide.
3.3 You are solely responsible for maintaining the confidentiality of your account login credentials, including your email and password. You are fully liable for all activities conducted under your account. You agree to notify us immediately of any unauthorized use of your account or security breach.
3.4 Your account is non-transferable. You may not assign, sell, or license your account to any third party.
3.5 We reserve the right to suspend, restrict, or terminate your account at our sole discretion, including but not limited to cases of:
– Fraudulent activity, payment disputes, or unauthorized transactions;
– Violation of these Terms or any of our supplementary policies;

4. Product Information & Availability

4.1 We strive to ensure that all product descriptions, images, pricing, and specifications on our website are accurate and up-to-date. However, we do not warrant that the content is completely error-free, complete, or current. Minor variations in product appearance may occur due to lighting, screen display settings, or the natural characteristics of gemstones and precious metals.
4.2 Natural gemstones used in our jewelry may feature inherent, unique characteristics including inclusions, subtle color variations, and natural textures. These features are part of the natural beauty and authenticity of the stone, and are not considered manufacturing defects. We do not accept returns or warranty claims based on natural variations in gemstones.
4.3 All product inventory is subject to availability. We reserve the right to limit the purchase quantity of any product, discontinue any product, or cancel orders for out-of-stock items at any time. If an item you ordered is out of stock, we will notify you via email and offer the option of a full refund or a replacement product of equivalent value, at your discretion.
4.4 For Pre-Order Items, the estimated shipping timeline listed on the product page is for reference only. We will notify you via email of any delays to the estimated dispatch date. Pre-Order Items cannot be canceled or modified after purchase, as they are reserved exclusively for you.
4.5 We retain all intellectual property rights to all product designs, images, and descriptions on our website. Unauthorized reproduction or use is strictly prohibited (see Section 12 for full details).


5. Ordering & Purchase Agreement

5.1 When you place an order through our website, you are submitting a binding offer to purchase the selected products in accordance with these Terms. You will receive an automated order confirmation email immediately after placing your order; this email only confirms our receipt of your order and does not constitute our acceptance of your offer.
5.2 We reserve the right to accept or reject your order, in whole or in part, at our sole discretion, at any time prior to dispatch. We may refuse an order for reasons including but not limited to:
– Product unavailability or inventory shortages;
– Obvious pricing or product description errors;
– Failure to pass our payment verification process;
– Suspected fraudulent or unauthorized activity;
– Violation of these Terms or applicable laws and regulations;
– Inability to ship to your provided destination.
5.3 A binding purchase contract between you and us is formed only when we dispatch your order and send you a shipping confirmation email containing a tracking number.
5.4 Order Modifications & Cancellations: You may request to cancel or modify your order (including changes to the shipping address, product specifications, or quantity) only before your order has been dispatched from our fulfillment center. We will make reasonable efforts to accommodate your request if the fulfillment process has not yet begun. Once an order has been dispatched, it cannot be modified, canceled, or rerouted.
5.5 We reserve the right to cancel any order at any time prior to dispatch, for any reason. If we cancel your order after payment has been processed, we will issue a full refund to your original payment method, with no additional liability to you.


6. Pricing & Payment Terms

6.1 All prices listed on our website are in United States Dollars (USD), unless otherwise specified. Prices include the cost of the product only, and do not include shipping fees, Customs Fees, taxes, or other charges, all of which are your sole responsibility unless explicitly stated otherwise.
6.2 We reserve the right to adjust product prices at any time, without prior notice. Price changes will not affect orders for which we have already issued a shipping confirmation.
6.3 Pricing Errors: In the event of an obvious and material pricing error (including but not limited to incorrect decimal placement, typographical errors, or prices significantly below market value), we reserve the right to cancel your order and refund any amounts paid, even if we have sent an order confirmation email. We will not be liable for any losses resulting from pricing errors.
6.4 Payment Requirements: Full payment for your order, including product price, shipping fees, and any applicable taxes, must be received and verified before we process and dispatch your order. Payment is charged in full at checkout, including for Pre-Order Items.
6.5 We accept the following payment methods: major credit and debit cards (Visa, Mastercard, American Express), PayPal, eligible regional installment payment services (including Klarna and Afterpay for eligible regions), Venmo, and Of Sheen digital gift cards.
6.6 You warrant that you have the legal right to use the payment method provided at checkout. You authorize us to charge the full order amount to your selected payment method.
6.7 Payment Verification: We reserve the right to verify the validity of your payment method and may request additional information to verify your identity and payment details. Failure to provide requested verification may result in order cancellation.
6.8 Foreign Transaction Fees: Any foreign transaction fees, currency conversion fees, or other charges imposed by your bank, card issuer, or payment provider are your sole responsibility. We do not receive any portion of these fees and have no control over their amount.
6.9 Price Adjustments: We offer one-time price adjustments for full-priced items only, if the same item is marked down within 7 calendar days of your Delivery Date. Price adjustments are not available for sale items, Pre-Order Items, Custom Products, limited-edition collections, or promotional discounted items.


7. Shipping & Delivery

7.1 All orders are processed and dispatched from our global fulfillment center within 1-3 Business Days after payment verification. Orders placed on weekends or public holidays will be processed on the next Business Day.
7.2 We offer worldwide shipping to most countries and regions via our network of trusted, insured international cross-border logistics partners. Shipping fees for orders below the free shipping threshold are calculated automatically at checkout based on your destination, package weight, and selected shipping service.
7.3 Free Shipping Policy: We offer free standard shipping for all orders with a pre-tax, pre-fee merchandise subtotal of $250 USD or more, valid for all shipping destinations we service. The $250 USD threshold is calculated based on the value of physical merchandise only; gift card purchases, taxes, and fees do not count toward the threshold. We reserve the right to modify or suspend the free shipping promotion at any time, at our sole discretion.
7.4 Delivery Timelines: Estimated delivery timelines are as Shipping&Delivery:
All delivery timelines are estimates only and not guaranteed. We are not liable for delivery delays caused by customs clearance, carrier transit issues, public holidays, natural disasters, or other events beyond our reasonable control.
7.5 We do not offer expedited or express shipping options for any destinations at this time. For shipments to the Philippines, only DHL Express shipping is available due to regional logistics limitations.
7.6 Once your order is dispatched, you will receive a shipping confirmation email with a unique tracking number and a link to track your package via the carrier’s website. For international orders, tracking updates may take 3-10 Business Days to appear due to cross-border carrier handover and customs clearance.
7.7 Risk & Title Transfer:
– Title (ownership) to the products passes to you upon our receipt of full payment for the order and handover of the products to the shipping carrier.
– Risk of loss, damage, or destruction of the products passes to you upon successful delivery and signature of the order at the shipping address you provided. We are not liable for lost, stolen, or damaged packages after the carrier confirms successful delivery.
7.8 Undeliverable Orders: If an order is deemed undeliverable by the carrier (due to incorrect/incomplete address, unclaimed delivery, refused delivery, or unpaid Customs Fees), we will notify you via email upon receipt of the returned package. You may elect to:
– Reship the order, upon payment of all applicable reshipping fees, return shipping costs, and any incurred penalties or Customs Fees; or
– Request a refund, which will be issued for the merchandise value of the order minus all outbound shipping costs, return shipping costs, and any incurred penalties or fees.
If we do not receive a response from you within 10 Business Days of our notification, the package will be deemed abandoned, and we reserve the right to dispose of the products with no refund issued.


8. Customs, Duties & Import Compliance

8.1 CRITICAL NOTICE FOR INTERNATIONAL CUSTOMERS: All Customs Fees, including import duties, VAT, customs clearance charges, brokerage fees, and local administrative levies, are the sole and exclusive responsibility of you, the recipient.
8.2 These Customs Fees are NOT included in the product price or shipping cost at checkout. We have no control over the amount of fees imposed by your destination country’s customs authority, and cannot provide a pre-purchase estimate of applicable Customs Fees. It is your responsibility to check the import policies and fee structures of your destination country before placing an order.
8.3 You warrant that the products you order comply with all import laws, regulations, and restrictions of your destination country/region. We are not liable for any packages that are seized, confiscated, or destroyed by customs authorities due to non-compliance with local import laws, and no refund will be issued for such orders.
8.4 If a package is refused, abandoned, seized, or returned to us because you fail to pay the required Customs Fees or complete customs clearance procedures:
– You will be held fully liable for all incurred outbound and return shipping costs, Customs Fees, penalties, and handling charges.
– All such costs will be deducted from any eligible refund for the order.
– If the total incurred costs exceed the order value, you will remain liable for the outstanding balance.
8.5 We do not reimburse Customs Fees under any circumstances.


9. Returns, Refunds & Exchanges

9.1 Our returns policy is governed by this section and our standalone Returns & Refunds Policy, which is incorporated into these Terms by reference.
9.2 Return Eligibility Window: We accept return requests for eligible items only within 30 calendar days of the Delivery Date. Requests submitted after this 30-day window will not be accepted.
9.3 Mandatory Return Eligibility Criteria: To be eligible for a return, the item must meet ALL of the following requirements:
– The item is unworn, unaltered, unused, and in brand-new, resalable condition, with no signs of wear, scratches, tarnishing, or contact with cosmetics, perfumes, lotions, sweat, or other substances;
– The item is returned in its original, unmodified packaging, including all branded boxes, dust pouches, authenticity certificates, gemstone grading reports, warranty cards, tags, and security seals;
– The item is not a Non-Returnable Item (as defined in Section 9.4);
– You have obtained a pre-approved RA Number from our customer service team before shipping the item back.
9.4 Non-Returnable Items (Final Sale): The following items are strictly non-returnable, non-exchangeable, and non-refundable under any circumstances:
– Custom Products, including engraved, resized, personalized, or made-to-order pieces;
– Pierced earrings, nose rings, body jewelry, and other intimate wearable pieces (once the original packaging or security seal has been opened, for health and hygiene reasons);
– One-of-a-kind high jewelry, limited-edition collections, and collaborative pieces;
– Precious metal investment pieces priced based on live market spot rates;
– All sale, promotional, clearance, and discounted items;
– Digital gift cards, downloadable content, and opened jewelry care products;
– Hazardous or flammable materials, including opened jewelry cleaning solutions.
9.5 Return Process: To initiate a return, you must contact our customer service team at {official customer service email} within the 30-day window to request an RA Number. We will review your request and respond within 2-3 Business Days.
– Packages returned without a visible RA Number on the outside of the package will be refused and returned to sender at your full cost, with no refund issued.
– You are solely responsible for all return shipping costs, Customs Fees, and handling charges for returned items. Return shipping costs are non-refundable, and will be deducted from your refund amount. We only cover return shipping costs for items verified to have manufacturing defects or shipping errors on our end.
9.6 Refund Processing: Once we receive your returned item, our quality control team will conduct a full inspection within 3-5 Business Days. We will notify you via email of the approval or rejection of your refund request.
– Approved refunds will be processed and issued to your original payment method within 7-10 Business Days of approval. We do not offer cash refunds, and cannot issue refunds to alternative payment methods or accounts.
– We reserve the right to issue a partial refund, or reject your refund request entirely, at our sole discretion, for items that do not meet the eligibility criteria in Section 9.3. This includes deductions for refurbishment costs, loss of resale value, or replacement costs for missing packaging/accessories.
9.7 Exchanges: We only offer exchanges for items verified to have a manufacturing defect, material flaw, or shipping damage upon delivery. We do not offer exchanges for reasons of personal preference, size changes, or change of mind.
– Exchanges are only available for the exact same item (identical style, material, size, and specification) as your original purchase. If the identical item is out of stock, we will offer complimentary repair services or a refund, at our sole discretion.
– All exchange requests are subject to the same eligibility criteria and pre-approval process as returns. International exchange shipping costs are your sole responsibility.
9.8 Jewelry Set Returns: Jewelry sets are eligible for return only if the entire set is returned in full. Individual pieces from a set cannot be returned separately.


10. Gift Cards & Promotions

10.1 Gift Card Terms:
– We offer digital gift cards in various denominations, available for purchase on our website.
– Of Sheen gift cards have no expiration date, and no dormancy or service fees apply.
– Gift cards are non-refundable, non-redeemable for cash, and cannot be used to purchase additional gift cards.
– You can redeem gift cards at checkout by entering the unique code in the designated field. Gift cards may be combined with other payment methods, but cannot be combined with multiple discount codes.
– We are not responsible for lost, stolen, or misused gift card codes, and will not replace or refund lost or stolen gift cards.
10.2 Promotions & Discount Codes:
– We reserve the right to modify, extend, or terminate any promotion, discount, or offer at any time, at our sole discretion, without prior notice.
– Discount codes are valid for a limited time only, as specified in the promotion terms. Discount codes cannot be applied retroactively to orders already placed or shipped.
– Only one discount code may be used per order, unless otherwise specified in the promotion terms.
– We reserve the right to reject or invalidate any discount code used in violation of the promotion terms, including fraudulent or unauthorized use.


11. Product Warranty & Disclaimer

11.1 Limited 100-Day Warranty: We offer a 100-day limited warranty on all Of Sheen jewelry products, commencing on the Delivery Date. This warranty applies exclusively to the original purchaser, is non-transferable, and requires valid proof of purchase.
11.2 Warranty Coverage: This warranty only covers verified manufacturing defects in materials and workmanship under normal, intended use of the product. If a manufacturing defect is confirmed within the warranty period, we will, at our sole discretion, either:
– Repair the defective product free of charge;
– Replace the defective product with an identical item (if in stock); or
– Issue a store credit for the original purchase price of the defective item.
11.3 Warranty Exclusions: This warranty does NOT cover:
– Normal wear and tear from daily use, including scratches, tarnishing, plating fading, and surface abrasion;
– Damage caused by improper care, including contact with water, chemicals, cosmetics, perfumes, heat, or excessive force;
– Accidental damage, including drops, impacts, crushing, or bending of the product;
– Damage caused by unauthorized modifications, resizing, engraving, or repair work performed by a third party;
– Loss, theft, or damage to the product during shipping or return transit;
– Natural variations in gemstones, including inclusions, color variations, and inherent characteristics;
– Damage resulting from misuse, abuse, or use of the product for purposes other than its intended wear.
11.4 Product Disclaimers:
– While all of our jewelry is hypoallergenic (lead-free, nickel-free, and cadmium-free), we cannot guarantee that no allergic reaction will occur in individuals with extreme metal sensitivities. You are responsible for testing the product on a small area of skin before full wear. We are not liable for any allergic reactions or skin irritation resulting from use of our products.
– Our plated jewelry is designed for durability, but the plating will naturally wear over time with frequent use and exposure to harsh elements. Tarnishing or plating wear from improper care is not a manufacturing defect and is not covered by this warranty.
– Nothing in this section limits your statutory rights as a consumer under applicable mandatory local laws.


12. Intellectual Property Rights

12.1 All intellectual property rights in our website, including but not limited to text, images, videos, graphics, logos, trademarks, product designs, packaging designs, and software, are the exclusive property of Of Sheen Fine Jewelry, protected by applicable copyright, trademark, and intellectual property laws worldwide.
12.2 You are granted a limited, non-exclusive, non-transferable license to access and use our website and content for personal, non-commercial use only, in accordance with these Terms.
12.3 You may not, without our prior written consent:
– Reproduce, distribute, modify, display, or publicly perform any of our copyrighted content;
– Use our trademarks, logos, or brand assets for any commercial or non-commercial purpose;
– Reverse engineer, decompile, or disassemble any software or code on our website;
– Scrape, crawl, or extract data from our website for any purpose;
– Create derivative works based on our product designs, content, or brand assets;
– Use our intellectual property to create counterfeit or replica products.
12.4 We reserve all rights to take legal action against any unauthorized use of our intellectual property, to seek full damages, injunctive relief, and recovery of legal fees.


13. Prohibited Uses

  • Providing false, misleading, or fraudulent information to us or other users;
  • Engaging in fraudulent transactions, payment disputes, or chargebacks without valid justification;
  • Unauthorized access to our website, user accounts, or internal systems;
  • Interfering with the operation of our website, including introducing viruses, malware, or other harmful code;
  • Scraping, crawling, or harvesting data from our website without our written consent;
  • Posting or transmitting any defamatory, obscene, offensive, or infringing content through our website;
  • Using our website or brand assets to engage in any illegal, unethical, or harmful activity;
  • Violating any applicable local, national, or international laws or regulations.

14. Indemnification

You agree to fully indemnify, defend, and hold harmless Of Sheen Fine Jewelry, its directors, officers, employees, agents, and affiliates, from and against any and all claims, demands, actions, losses, liabilities, damages, costs, and expenses (including reasonable legal fees and court costs) arising from or related to:

  • Your violation of any applicable laws, regulations, or third-party rights;
  • Any fraudulent activity or misrepresentation by you;
  • Any disputes between you and a third party related to your order or use of our products.

15.1 To the fullest extent permitted by applicable law, in no event shall Of Sheen Fine Jewelry, its directors, officers, employees, agents, or affiliates, be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, loss of revenue, loss of goodwill, loss of data, or cost of substitute goods, arising from or related to your use of our website, products, or services, whether in contract, tort (including negligence), or otherwise, even if we have been advised of the possibility of such damages.
15.2 In no event shall our total aggregate liability to you for any and all claims arising from or related to your order or use of our services exceed the total amount you paid to us for the specific order in question.

For customers in the European Union, United Kingdom, Australia, and other regions with mandatory consumer protection laws, nothing in these Terms affects your statutory rights as a consumer.

16. Force Majeure

We shall not be liable for any failure or delay in performing our obligations under these Terms, including but not limited to order processing, shipping, or delivery, caused by events beyond our reasonable control (“Force Majeure Event”). A Force Majeure Event includes but is not limited to:

  • Natural disasters, including earthquakes, floods, fires, and pandemics;
  • War, terrorism, civil unrest, or government sanctions/embargoes;
  • Strikes, labor disputes, or supply chain interruptions;
  • Carrier or logistics service disruptions;
  • Internet outages, system failures, or cyberattacks;
  • Changes to laws, regulations, or customs policies.

In the event of a Force Majeure Event, we reserve the right to suspend performance of our obligations for the duration of the event, and to delay, partially fulfill, or terminate your order without liability to you.


17. Governing Law & Dispute Resolution

17.1 These Terms shall be governed by and construed in accordance with the laws of the People’s Republic of China, excluding its conflict of law rules.
17.2 Any dispute, controversy, or claim arising out of or in connection with these Terms, including its formation, validity, performance, breach, or termination, shall first be resolved through good-faith friendly negotiation between the parties.
17.3 If the dispute cannot be resolved through negotiation within 30 calendar days of one party notifying the other of the dispute, either party shall have the right to submit the dispute to the competent people’s court in our domicile for litigation.
17.4 For customers in the European Union, you may also have the right to resolve disputes through an online alternative dispute resolution (ADR) platform. We are not obligated to participate in ADR proceedings before a consumer arbitration board.
17.5 Nothing in this section prevents us from seeking injunctive relief in any court of competent jurisdiction to protect our intellectual property rights or prevent ongoing harm to our business.


18. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from these Terms, and the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely matches the original intent of the provision.

These Terms, together with our Shipping & Delivery Policy, Returns & Refunds Policy, Privacy Policy, and any other written agreements between you and us, constitute the entire agreement between the parties with respect to the subject matter herein, and supersede all prior or contemporaneous oral or written agreements, understandings, or representations, whether express or implied.
